Letter: appoint a surveyor within 10 days
Once the 14-day reply window has passed with no written consent on a Party Structure or Excavation Notice, a dispute is deemed to have arisen. This letter asks your neighbour to agree an agreed surveyor with you or appoint their own, and starts the 10-day clock in section 10(4) of the Act. If they do nothing for 10 days beginning with the day it is served, you may appoint a surveyor on their behalf.
This is our drafting, not a GOV.UK letter. GOV.UK publishes no example for this step. Have a party wall surveyor check it before you rely on it, and only use it after the 14-day window has genuinely closed.
Serve it the same way as the notice (in person, by post, or by email if they agreed to email), date it the day you serve it, and keep a copy and proof. Count the 10 days from the day of service as day 1.
